Pemerintah Bakal Revisi 4 Pasal UU ITE
INFOKA.ID – Pemerintah bakal merevisi empat pasal dalam Undang-undang (UU) Nomor 19 Tahun 2016 tentang Perubahan Atas UU Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE).
Menteri Koordinator Bidang Politik, Hukum, dan Keamanan (Menko Polhukam) Mahfud MD menjelaskan, revisi tersebut satu paket dengan penambahan satu pasal dalam UU ITE, yakni pasal 45C.
“Ada empat pasal yang akan direvisi. Pasal 27, pasal 28, pasal 29 dan pasal 36, ditambah satu pasal 45C, itu tambahannya,” ujar Mahfud seperti dikutip dari Kompas.com, Selasa (8/6/2021).
Adapun pasal 27 UU ITE berisi empat ayat, meliputi:
Ayat (1) “Setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya informasi elektronik dan/atau dokumen elektronik yang memiliki muatan yang melanggar kesusilaan”.
Ayat (2) “Setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya informasi elektronik dan/atau dokumen elektronik yang memiliki muatan perjudian.”
Ayat (3) “Setiap orang dengan sengaja, dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya informasi elektronik dan/atau dokumen elektronik yang memiliki muatan penghinaan dan/atau pencemaran nama baik”.
Ayat (4) “Setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya informasi elektronik dan/atau dokumen elektronik yang memiliki muatan pemerasan dan/atau pengancaman”.
Pada UU Nomor 19 Tahun 2016 tentang Perubahan Atas UU Nomor 11 Tahun 2008 tentang ITE menjelaskan bahwa ketentuan pada ayat ini mengacu pada ketentuan pemerasan dan/atau pengancaman yang diatur dalam Kitab Undang-undang Hukum Pidana (KUHP).
Kemudian Pasal 28 dalam UU ITE berisi dua ayat.
Ayat (1) “Setiap orang dengan sengaja, dan tanpa hak menyebarkan berita bohong dan menyesatkan yang mengakibatkan kerugian konsumen dalam transaksi elektronik”.
Ayat (2) “Setiap orang dengan sengaja dan tanpa hak menyebarkan informasi yang ditujukan untuk menimbulkan rasa kebencian atau permusuhan individu dan/atau kelompok masyarakat tertentu berdasarkan atas Suku, Agama, Ras, dan Antargolongan (SARA)”.
Selanjutnya Pasal 29 UU ITE yang berbunyi, “Setiap orang dengan sengaja dan tanpa hak mengirimkan informasi elektronik dan/atau dokumen elektronik yang berisi ancaman kekerasan atau menakut-nakuti yang ditujukan secara pribadi”.
Terakhir, Pasal 36 UU ITE yang berbunyi, “Setiap orang dengan sengaja dan tanpa hak atau melawan hukum melakukan perbuatan sebagaimana dimaksud dalam pasal 27 sampai dengan pasal 34 yang mengakibatkan kerugian bagi orang lain”.
Sebelumnya, Tim Kajian UU ITE telah melakukan diskusi panjang dengan sejumlah narasumber beberapa waktu lalu. Diskusi itu melibatkan para korban yang terjerat UU ITE.
Langkah ini dilakukan setelah Presiden Joko Widodo menginginkan revisi UU ITE.
Hasil kajian itu kemudian memutuskan adanya revisi empat pasal, penambahan pasal 46C, dan SKB tiga kementerian dan lembaga mengenai pedoman implementasi. (*)
